Questions we get asked

How long does the council have to decide?

Councils normally have eight weeks to decide an application to discharge conditions, unless you agree longer. Getting the detail right first time avoids a second round.

Do construction traffic effects matter under national policy?

Yes. The 2026 NPPF makes clear the highways tests apply during construction as well as once a scheme is built.

What discharging a condition involves

Most planning permissions carry highways conditions. Some must be met before work starts, such as a Construction Traffic Management Plan. Others apply before anyone moves in, such as building the access and keeping visibility splays clear.

Each pre-commencement condition needs a formal application to the planning authority, with the details the condition asks for. The council consults the highway authority, so the information has to answer the officer’s questions first time.

  • We read each condition against its stated reason, so the submission answers what the council actually needs.
  • We prepare the plans, drawings and notes, and agree them informally with the highway officer where that saves a round of comments.
  • Where a condition is unclear or unreasonable, we say so early. Sometimes a variation is the faster route.
